GOVERNMENT PROCLAIMS MONEY JUDGMENT ENFORCEMENT LEGISLATION

The Saskatchewan government is proclaiming legislation that will change the procedure for the enforcement of money judgments.

Effective May 28, 2012, The Enforcement of Money Judgments Act will replace outdated Acts to introduce a new and more effective enforcement process. Previously, existing legislation included a number of Acts and Regulations, many of which date back more than 50 years.

"This new legislation will improve access to justice by streamlining the way money judgments are enforced in this province," Justice Minister and Attorney General Don Morgan said. "This will make it easier and more efficient for Judgment Creditors who have gone through the judicial process and successfully obtained a judgment."

Information Services Corporation (ISC) will be responsible for the registration of judgments in the new Judgment Registry. To prepare for this, several changes to the system and technical upgrades have been made to accommodate the new legislation.

"This is a big step forward for Judgment Creditors and the way in which they will be able to obtain current information about their money judgments and debtors on a province wide basis," Minister responsible for the Information Services Corporation Tim McMillan said.

The new legislation also updates the exemption rules protecting Judgment Debtors and it will provide the Sheriff's Office with a larger role in enforcing judgments. Changes have also been made to modernize the internal procedures of the Sheriff's Office to ensure that they can be effective in this new role.
