The owner of Advanced Roofing of Moose Jaw, Justin Fall, has pleaded guilty to three charges under Saskatchewan's Occupational Health and Safety regulations and been fined a total of $1,560.
Fall pleaded guilty to:
- contravening section 253(2)(b) of the regulations for failure to ensure that a ladder in use by workers was secured (fined $300 plus $60 victim fine surcharge);
- contravening section 116(2)(a) of the regulations for failure to ensure workers use a fall protection system where a worker may fall three metres or more (fined $600 plus $240 victim fine surcharge); and
- contravening section 116.1 of the regulations for failure to have a written fall protection plan (fined $300 plus $60 victim fine surcharge).
Two additional charges against Fall under the Occupational Health and Safety regulations were stayed in court.
The charges were laid after a proactive routine inspection by an Occupational Health Officer, who observed four workers shingling a roof without protection against falling, at a worksite in Moose Jaw.
Occupational Health and Safety has a zero tolerance approach to non-compliance or violations of fall protection legislation.
OHS conducts approximately 4,000 worksite inspections annually to ensure standards are known, understood and enforced.
